Every state follows pretty much the same requirements for getting a replacement title but the procedures for running the gauntlet are different. A vehicle title (or a car title) is a legal form, establishing a person or business as the legal owner of a vehicle. Vehicle titles in New York are issued by the New York Department of Motor Vehicles.

The certificate of title normally specifies:

1. Identifying information about the vehicle, normally at minimum its vehicle identification number, make, and year of manufacture.
2. Technical information about the vehicle to define its taxation regime, such as its gross vehicle weight and motive power.
3. The name and address of the purchaser or "registered owner" who would normally possess and use it.
4. If money is owed on the vehicle, the name of the lien holder or "legal owner" to whom this money is owed.

When a vehicle is financed, the certificate of title is normally held by the lender, who must release it to the purchaser once the balance is paid off. When a car is sold from one owner to another, the title must be transferred to the new owner. This is achieved by requesting approval by the New York DMV.

Some states issue titles, some don't! What?! Well, according to the manufacture year you may need a Registration instead. Note: Vehicles owned by the government may be treated differently.

Title Issuing State: Yes - NY issues titles to cars manufactured 1973 and newer, for 1972 and older a transferable Registration Receipt or MV-353, Certification of New York State Registration for Transfer of Non-title Vehicle. NY issues titles for Kit cars, junked vehicles, boats(restrictions apply), RVs, motorcycles, buses, government owned cars, and mobile homes (restrictions apply).

Title Application: Hand-written applications are accepted. Complete a MV-82, or MV-82TON and submit in person with proof of ownership, proof of name and date of birth, and application fee.

Processing Time: The NY DMV normally processes applications in (3) weeks for a title only application (vehicle titled in NY) and (4) four to (10) ten weeks for a title and registration application.

Motorcycles: In New York, a vehicle with the seat at least25 inches off the ground, no more than 3 wheels, and able to attain speeds greater than 40 mph, requires a title.

Proof of Ownership in New York

New Vehicles: NY accepts Certificates of Origin along with a Certificate of Sale (Form MV-50) required from a New Yorkdealer. Vehicles from out-of-state dealers require a Bill of Sale approved by the state the dealer resides in.

Out-Of-State Vehicle: A certified copy of the title or an Out-of-state Title and letter of permission if the lien holder has the title.

Used Vehicles: - Non-titled - If the vehicle is coming from a state that does not require titling of the vehicle,then NY DMV will accept the appropriate documents recognized by the issuing state

Helmets Required: YES - NY Requires helmets for motorcycles and for people under 14 using bicycles, in-line skates,or a scooter.

Safety Belts / Child Restraints Required: YES - New York requires that all backseat passengers under the age of (4) four are restrained in a specially designed seat which meets the Federal Motor Vehicle Safety Standards. Anyone under (10) ten years old must be restrained by a safety belt. No person may operate a vehicle without being properly restrained by a safety belt and passengers shall be restrained by safety belts also.
